Digital Certification for Foreign Investors: How to Obtain It?
One of the most significant changes for international investors interested in Brazil was the authorization, via Law 14.195/21 (Business Environment Law), which allows non-resident foreigners to act as administrators of Brazilian companies. This relaxation aims to simplify procedures and position the country more competitively in the global investment landscape.
However, legal theory does not always translate into immediate and straightforward practice. In business operations, two fundamental processes continue to present specific challenges for foreign administrators: opening bank accounts and obtaining the Digital Certificate, an indispensable tool for tax, banking, and legal operations in Brazil.

1. Can a foreigner obtain an e-CPF (Digital Certificate for Individuals)?
Yes. Brazilian legislation allows foreigners, regardless of their residence, to have a CPF and, consequently, obtain their digital certificate.
2. Can a non-resident foreigner (living outside Brazil) also obtain it?
Yes. The absence of a fixed residence in Brazil is not an impediment to issuing an e-CPF or e-CNPJ.
3. What documents are needed to apply for an e-CPF?
The main requirement is to have an active CPF. To carry out the process remotely (via videoconference), the applicant must have a Brazilian National Driver's License (CNH) with registered biometrics OR have previously completed biometric collection for a previous digital certificate. Without these requirements, the procedure must be done in person in Brazil.
4. What about obtaining the e-CNPJ (Digital Certificate for Legal Entities)?

For e-CPF, representation by power of attorney is only permitted in exceptional cases of absolute legal incapacity. For e-CNPJ, it is possible, provided that the company's articles of association expressly grant this power to the administrator and specify the limits of representation.
